Terms & Conditions
These terms apply when you access MuseX or purchase a product from us.
1. About us
MuseX is operated by Elevia Labs, Vienna, Austria (“MuseX”, “we”, “us”). Contact us at contact@musex.shop.
2. Adults only
You must be at least 18 years old and meet the legal age requirement in your location to access this website or place an order. By using MuseX, you confirm that you meet those requirements.
3. Products and orders
Products are sold directly by Elevia Labs and produced or fulfilled through third-party partners. Product images and descriptions are illustrative; minor differences may occur in made-on-demand items. An order is accepted when we send an order confirmation. We may reject or cancel an order where a product is unavailable, payment cannot be authorised, delivery is not available, or we reasonably suspect fraud or a legal restriction.
4. Prices and payment
The total price, applicable taxes, delivery charges, and available payment methods are displayed during checkout before you place an order. You are responsible for providing accurate billing and delivery information.
5. Production and delivery
Products are made on demand and delivered by third-party fulfilment partners. Estimated production and delivery times shown at checkout are estimates rather than guaranteed dates. Delivery availability depends on the destination, local restrictions, and carrier coverage. You are responsible for any import duties or taxes clearly disclosed as not included at checkout.
6. Cancellations
You may request cancellation by emailing contact@musex.shop before your order ships. Include your order number. Once an order has shipped, it cannot be cancelled.
7. Withdrawal and returns
Many MuseX products are made to your specifications or clearly personalised. Intimate products may also be supplied sealed and become unsuitable for return for health or hygiene reasons once unsealed. Where an applicable legal exception applies, there is no change-of-mind right of withdrawal. This does not limit any mandatory rights you have under applicable consumer law.
If a non-personalised product remains sealed and no legal exception applies, you may have a statutory withdrawal right. Contact us before opening or returning it so we can confirm the applicable process.
8. Faulty, damaged, or incorrect products
The return restrictions above do not affect your statutory rights. If a product is faulty, damaged on arrival, or not what you ordered, contact us promptly with your order number and supporting photographs. Where required by law, we will provide an appropriate remedy such as repair, replacement, price reduction, or refund.
9. Acceptable use
You may not misuse the website, attempt unauthorised access, interfere with its operation, copy protected content without permission, or use MuseX for an unlawful purpose.
10. Liability
Nothing in these terms excludes liability that cannot legally be excluded. To the extent permitted by law, we are not responsible for indirect or unforeseeable losses, or delays caused by events outside our reasonable control.
11. Governing law
These terms are governed by Austrian law, without depriving consumers of mandatory protections available under the law of their country of residence. Courts with jurisdiction under applicable consumer law may hear disputes.
12. Changes
We may update these terms for future use of MuseX. The version in effect when your order was placed continues to apply to that order.
